Guys I have had a professional motocross practice track for 12 years on my folks farm. All of a sudden The insurance company sais shut her down or will cancel insurance. They wanted 15,ooo$ a year extra for me to let people just ride out there.[ no races] I tried contacting other insurance companies they woulnt even think about it because of government regulations. This is for the birds. All they did was take away a recreation area for kids. Would they rather are kids run the streets and get into trouble. I am trying to find more information on how we can fight for our riding areas besides what the A.M.A is doing. Does anyone know any other organizations that are fighting for our rights? This would of been a great area to hold a organized event.
I moved this thread to the land use issues. Try to keep the buggy bash thread to that topic.
Regarding the problem you are having, there are so many people having the same issues. Here in NJ we are having problems with all most all of the riding facilities due to big brother and the extreme left groups.
Most of these insurance companies could care less about our kids and what they are doing they just simply do not want to pay any money out. _________________ Randy

This is another example of those liberal idiots closing the areas that the decent people liked to use. Senator Boxter, Senator Feinstein, and Alan Cranston were the lead people in getting most of the California deserts shut down, and Clinton just signed away, which is the main reason for all of the gangs and horrible people that run the streets in California. I feel for you, but this is a direct result of there being too many people in this country, and when that happens, people have this need to control everything, and force the control on other people. Welcome to the beginning of the end to freedom. _________________ Dan Alustiza

Actually, IMO, this is caused by too many lawyers in this world. Hypothetically, say an accident happens(and an accident is just that -an accident) and one of your kids friends gets hurt. A lawyer is going to whisper in that kids' parents ear and the next thing you know-your butt is dragged into court. Its a shame but that is the way it is.. So you're right in a sense that the insurance companies don't want to pay, but it's the lawyers that are trying to get million dollar settlements from the insurance companies-Which BTW is our money..

I wouldn't necessarily point your finger at the insurance companies, all they do is assign a value to the risk you have there. The risk is determined by historical claims that are made. The claims tend to get inflated by everybody with their hand out, namely PI attorneys, physicians, and let's not forget the ever so popular pain and suffering money. You're right, it is a joke, but the insurance company is just selling you protection at the price they're (somewhat) forced to sell it for. Like any other business in this great country, they're in it to make money.
It's a sad state of affairs but there is no one person or entity to point your finger at.
That's a nice track. I'm fortunate in that my family and my friend's family have multiple areas where we can ride, but I have to be careful who to invite for fear of someone getting hurt. If the wrong person gets hurt, who knows what could happen. _________________ Ron

The bad part is I had 5 different attorneys sit down and right up some fancy disclaimer and waiver. Anybody that rode there signed it and wore full protective gear. Some people even brought out there own disclaimers waiving any fault of mine if they got hurt or their children. Over the years there were many people unfortunately that got hurt and in one very tragic instance there was a death out there and nothing was even mentioned to the insurance company about a lawsuit. I know I have a lot of very hurt children and professional riders from all over the world. This was a nationally known track. I have professional teams and riders still calling wanting to come ride because you just dont find practcice tracks like this anywhere especially with the nice Iowa soil. Its just a shame. I am a very pleasant person, but cases like trhis make me want to ring some politician, lawyers, and insurance company NECKS!!! _________________ 2006 carter gx150llr lots of goodies

Sorry to hear the bad news. This is more of what has been happening with land used for off-road recreation since the early 1970's. It is not limited to Iowa.

I think you stated the reason why they are charging you so much money. It's a numbers thing... I wonder what they would quote your for insurance if you hadn't had any accidents? It typically doesn't have anything to do with the number of claims, it has to do with the number of events over a given period of time. My wife works for an insurance company and I've learned over the years that it's a numbers game.
You stated that they want to charge you $15k per year. You aslo stated that you have a lot of teams that want to use your facility. Charge them more money. Pass the cost on to the users. If you're doing this to make money, make money. If you're doing it to break even, then charge just enough to do just that. I know it sounds rough, but if you've got a resource that people want to use they'll pay you for it. It's the price of doing business for you and them.
I ride my buggies at work. We have ~100 acres to play around in. I'd love to have a get together with some local BN guys, but I can't. I can't take the risk of establishing "public" access. Once I do that my insurance for the business goes through the roof. We're an Environmental Engineering firm, we can't start tossing that kind of money into something that's a hobby.
Heck I have to carry a few million dollars in liability insurance personally just in case someone wants to sue me for a business related issue or hurting themselves walking across my yard. That's just the way it is now. It sucks, but it's a fact of life now.
I grew up near you (North Central Missour) back when things like this didn't matter. You could do whatever you wanted.
I feel for you man...
Hang in there and don't give up. Keep looking for a solution. It'll come to you. _________________ Chris Dierkens
