I haven't been here in a while, and for good reason, I haven't had anything to talk about since our little Dazon Mini-Raider 90 has been in the shop for nearly 5 months.

I have asked for my money back (no word back), but I ordered this directly from Dazon so I don't know if I will need to use the Lemon Law or what that involves.

I purchased it for Christmas, and gave it to the boys, after the weather cleared (a month and a half) we were able to take it to my Dad's and ride around, somewhere between 1 and 2 hours. Then the transmission locked up completely, engine ran but nothing else. I was instructed to take it to Gander Mountain (local service dealer for Dazon), they said no problem and took it apart. Ever since then they have been waiting for parts. The tech says, and I quote, "the engine is in a million pieces", I check back every few weeks or so with no progress, I'm sure they are tired of looking at it.

This has been going on for too long, I simply want my money back, but I payed through paypal so I can't dispute with credit card company.

Any advice on how to use the Kentucky Lemon Law, I checked and it says if it has been in the shop for 30 days then I have a valid claim, but how do I go about getting my money back. I have been extremely patient and always try to be polite, I did not ask for my money back until this week, I no longer want it fixed (I have no faith that it will ever be put back together anyway).

thanks in advance,
Kell

Can anyone help with the Lemon Law, I know I am entitled to a refund if it has been in the shop over 30 days in Kentucky, well it has been in there for over 5 months.

So do I get a lawyer? any advice appreciated,

thanks!

I would definitley ask a lawyer what it would cost to put some pressure on Dazon or Gander. Youve gotta kinda weight the cost of legal representation with the cost of the buggy and your time. Of course if youre like me I wouldnt care Id just get a lawyer because I hate feeling cheated.

wow kell i don't know what to tell you but it seems like someone is giving you the run around Mad i have been reading here for a while and always herd good things about dazon, makes a person wonder now.
its funny you can go to dazon.com and they show a parts brake down for that buggy weather they have the parts or can get them i don't know.
5 months i think you have been more then patient.have you thought about calling them again with your problem and telling them that people here on buggynews know whats going on.
i didn't join here to be a trouble maker but i don't think they have given you a fair shake on this deal.
just my thoughts

Paypal only lets you file a dispute for the first couple of months, and during that first couple of months I was giving them him the benefit of the doubt.

thanks for the advice guys,

Kell

You know a bit over a year ago is when I bought my Dazon Raider 150 from Gander Mountain and well right off the bat I was having problems loose bolts, broken fenders, tire leaking from day one headlight short (they assembled it) and I took it back for service well it sat and sat and sat not even being touched I heard the same excuses from Gander that they were waiting for parts well I went a bit further and contacted Dazon directly talked to someone who had stated to me that every single part they were waiting for was in stock I guess according to Dazon Gander is really strange when it comes to ordering parts the store manager has to OK the service guy to order them then it goes to a corporate Gander store for further approval I got fed up and asked them if they would just trade it out for a new one (they had a few in stock) well weeks went by with no reply to that so I finally went back down there the store manager I guess didnt know anything about anything but did deny me to trade it out so well I said OK how about this you know what parts need to be ordered I will take my buggy back and actually enjoy it (no mechanical problems) and then I will either bring it back in to have the parts swapped out or I will bring in the old parts and trade them out if thats ok well they agreed to that but now still a year later still no parts! Obviously out of warranty now so I just bit the bullet and took it as a loss. Funny how Dazon was really friendly to me told me that all the parts were in stock (I also asked if I could just get the parts directly from them) He had the service guy contact me via email and toild me that yes the parts were in stock but then gave me prices for all the parts I said this is still under warranty and everything was supposedly suppose to be covered never heard back from them after that either.....I honestly even after all the reading I have done about them arent very happy with my Dazon nor Gander Mountain I should have went to Northern Tool and bought the same buggy my brother in-law did the Maxxam (which is basically a Carter) its faster than mine and he hasnt had ANY problems with his (mine is down once again now due to a broken motor mount) His was faster stock for stock, mine with intake and exhaust his stock, and now that they are both modded of course his is still faster and he has more options for upgrades as well like a big bore and more exhaust options I was stuck paying over $200 for the White Brothers exhaust. The only 2 things I like mine better than his is my seats, and more comfortable of a ride....

Sorry for the long post and rant but I would DEFINATELY contact a lawyer and see about getting a full refund cause otherwise either it will sit at Gander for ever or you will be picking it up and paying for everything out of pocket....
