Tjat would like me going out and buying a 1100cc sport bike and taking it out for the first time and and twisting the throtle wide open going from first gear to second then blaming Honda for me busting a rear end on the black top when the bike flipped back and throwed me off Rolling Eyes . I feel sorry for the guy loosing his finger but he can't blame Carter for this. I think the man never read the warnings in the book and on the buggy.
Like the saftey info on page 3 of the Talon owners manual

"Take Time to Learn & Pratice

Even if you have driven other karts, take time to become familiar with how this kart works and handles.
Because many accidents involve inexperience or untrained drivers, we urge all drivers to take a training course approved by the go-kart saftey Institute. Check with your dealer for more information on training courses."

I guess this man never read the owners manual. Very sad..

Jeff

the only one going to pay for this is you and me, the buggy owners, this bad publicity is what starts all the negative things that people will see, they will stop looking at the pros of it and consentrait on the cons,"ohh they'er dangerous", and all for what this one mans bad experience, ya he lost a finger, get over it, when I was a kid 30+ yrs ago they taught me to keep my hands in the bus, rocket sicence.
the end result ; we pay more for the buggies
we pay more for admition to parks (to cover
possible law suites)
we have less places to ride (because people
are scared of law suites)
next there will be a mandated class to take (like with PWC), alright I maybe pushing that one, but you get my point, as for the law suite he does not have a prayer, kids 12, stop, end of disccusion.

ok i have the same kart (gx 150 IIr) and have never seen nor heard my tire rub or slam against the frame. as a matter of fact the only thing it deos hit is the fender (i know cuz i broke mine off on my 1st ride) and even that wouldn't cause the kart to flip. ive fliped mine one time already and it was because i was doing donuts in the grass i throttled up too much and got it up on 2 wheels, now i tried to see how long i could hold it like that and wasn't paying too close attention to the ground that i was about to hit, thats all. i've gone up hills at an angle, down hills into turns on pavement and still have not come close to flipping it. now as for this guy and his deal, i feel bad that his finger is gone and all, but the first thing they tell you to do when you get your paperwork on the pick up day is to read the manual and on page three (like someone mentioned before) it deos say that you should take the time to learn and practice slowly with it and it also say's that accidents do mostly accure because of young and inexperienced drivers taking them out and riding them like it was a car and they know everything. So i live here in Miami where this guy lives, and where they said he was riding it, is not a sanctioned place to ride an offroad gokart, and therefore what he was doing is and can be cosidered ilegal, in which that would nulify his entire case. and on top of that the child that was driving was 12 years old and im looking at my user manual right now and on the cover it says "MINIMUM RECOMENDED OPERATOR AGE: 16", then on page 1 it says "THANK YOU FOR PURCHASING OUR KART. WE HOPE YOU WILL ENJOY IT. BEFORE YOU START TO OPERATE THE KART PLEASE READ THROUGH THIS OWNERS MANUAL CAREFULLY AS IT CONTAINS IMPORTANT SAFETY AND MAINTENANCE INFORMATION. FAILURE TO FOLLOW THE WARNINGS CONTAINED IN THIS MANUAL CAN RESULT IN SERIOUSE INJURY OR DEATH". if this guy really did what a truly responsible parent would do first he would have read the front cover of the manual and known that his 12 year old daughter was not allowed by the manufacturer to operate this kart. then he should've looked at the third page and so on and seen all of the warnings telling you to take the time to practice and so on.
i could write about this all day. So all in all i think this guy is going to have a relly hard time getting money for this case seeing how he has so many infractions on operating this kart to begin with.

This was truly operator error. very unfortunate error...but operator error. The guy should be thankful he just lost his finger and not his 12 year old daughter in the accident. Some people just look for someone else to blame and...I hate to say it......but, an easy way to earn a large sum of money so they don't have to work for a while....yes.......a free ride. I know people like this personally. one guy is actually a friend of mine and prides himself on this fact.<<<<----lazy rascal.

Kind of scary to think about..I was looking at my NST 250 and noticed since purchase that the control arms are of UN-equal length. It turns much further to the right than the left. This allows the fender to slide under the passenger side frame rail and actually comes in contact with the passenger at times. The drivers side is much futher away. I saw this when I purchased it and was thinking about adjusting the arms to make them equal length. With that said, the tire obviously comes much closer to the frame than on the oppsite side, so I can see how if you hit hard enough, the tire could come in contact and flip the buggy. I am thinking he probably assembled the buggy partially, but usually, the front steering racks are already assembled. They were on my 2 chinese purchases anyway. But yes, definitely operator error looking for a free paycheck and someone to blame for his lack of knowledge. Keep an eye on this one folks, If he wins...buggies are gonna have to change

I can turn hard both ways in my DLX150IIR and clear the frame just fine. Neither tire can contact the frame.

yeah, I need to make my arms equal length..The right arm is about 2in from the frame on a right turn...just a bit of adjustment..I could see how it might hit and cause an accident if I came down hard on the right side and the tire hit the frame....but that would be because I HIT HARD ON THE RIGHT SIDE..operator error...stupid is as stupid does I believe Mr. Gump said Surprised Very Happy Very Happy

i don't know if you guys actually read my whole thread but i have the exact same model of the exact same year and it deos not rub against the frame. if it actually did rub then that means that whoever built it did a horrible job. Both my tires leave about an inch and a half spacing between the tire and the frame. deff. operator and parental error.
